Read carefully. Every shooter and visitor must agree to these terms before entering the range. By signing (in-store or electronically) you give up substantial legal rights.
In consideration of being permitted to enter, use, observe at, or participate in activities at the indoor shooting range, retail store, and premises operated by Einspahr Management Group, LLC d/b/a The Bullet Hole ("The Bullet Hole," "we," "us," or "our"), I, the undersigned participant (or the parent/legal guardian signing on behalf of a minor), agree to the following:
I understand that the use of firearms and the use of a shooting range are inherently and unavoidably dangerous activities that can result in serious bodily injury, permanent disability, hearing or vision loss, exposure to lead and other contaminants, property damage, or death — to myself or to others. These risks include, but are not limited to:
I knowingly and voluntarily assume all such risks, both known and unknown, and assume full responsibility for my participation and for any minor or guest in my care.
I understand and agree that The Bullet Hole operates as a self-regulated, self-supervised range. The Bullet Hole does not guarantee that a dedicated staff range safety officer will be stationed on the firing line at any given time, and I agree that I am not relying on any such supervision.
I acknowledge and agree that:
To the fullest extent permitted by Nebraska law, I hereby release, waive, discharge, and covenant not to sue The Bullet Hole, Einspahr Management Group, LLC, and its owners, members, managers, officers, employees, agents, instructors, volunteers, affiliates, landlords, and assigns (collectively, the "Released Parties") from any and all claims, demands, liabilities, damages, costs, or causes of action of any kind — including those arising from the ordinary negligence of the Released Parties — that I, my heirs, or my representatives may have arising out of or related to my presence at or use of the premises, range, equipment, rentals, instruction, products, or services.
I understand that this release does not apply to conduct that is found to constitute gross negligence, willful or wanton misconduct, or any liability that cannot be released by law.
I agree to indemnify, defend, and hold harmless the Released Parties from any loss, liability, damage, claim, or cost (including reasonable attorneys' fees) arising out of my conduct, my violation of any rule or law, or any injury or damage I cause to any person or property while on or related to the premises.
I represent, warrant, and certify that:
I agree to obey all posted rules, all firearm safety rules, and all directions given by staff, including but not limited to: treat every firearm as if it is loaded; never point a firearm at anything I am not willing to destroy; keep my finger off the trigger until my sights are on target and I am ready to fire; be certain of my target and what is beyond it; keep firearms pointed downrange at all times; and use only approved ammunition (no steel-core, armor-piercing, tracer, or incendiary rounds). I understand The Bullet Hole may refuse service to, or remove, any person for any lawful reason, including unsafe conduct, with no refund.
I understand that discharging firearms and handling ammunition, targets, and spent casings can expose me to lead and other substances known to be hazardous to health. I agree to wash my hands and face after shooting, to follow all posted health precautions, and I assume all risk of such exposure. Pregnant individuals and those with elevated health sensitivities should consult a physician before participating.
A person under 18 may be present on the range or shoot only while accompanied and directly supervised at all times by their parent or legal guardian, who must sign this Waiver on the minor's behalf. The signing parent/guardian assumes all risks on behalf of the minor, agrees to all releases and indemnities above as to the minor, and is solely responsible for the minor's conduct and safety.
I understand the premises may be monitored by security cameras for safety. I grant The Bullet Hole permission to use photographs or video taken on the premises in which I may appear for security, safety, and ordinary business purposes. (If you do not wish to consent to marketing use of your likeness, notify staff in writing.)
This Waiver is governed by the laws of the State of Nebraska, without regard to conflict-of-law rules. I agree that any dispute will be brought exclusively in the state or federal courts located in Sarpy County, Nebraska. If any provision is held invalid or unenforceable, the remaining provisions remain in full force and effect, and the invalid provision will be enforced to the maximum extent permitted by law.
I have read this Waiver, Release & Assumption of Risk, fully understand its terms, understand that I am giving up substantial rights by signing it, and sign it freely and voluntarily without any inducement. This Waiver remains in effect for all of my current and future visits unless revoked in writing.
